Terms of Use for “Recruitment Service”

When applying to use the recruitment service provided by PRINCESITA Co., Ltd. (hereinafter referred to as “the Company”), please apply after agreeing to the following Terms of Use (hereinafter referred to as “these Terms”):

1. (Definitions)

The definitions of terms used in these Terms are as follows: 

a. Recruitment Service

The Recruitment Service refers to the collective term for the following services: matching the application details received from the User with the hiring conditions desired by the hiring company; providing job postings and supplementary job information; offering career counseling via telephone or in-person meetings; and supporting the application process. 

b. User

Refers to an individual who has applied to use the Recruitment Service, and whose application has been accepted by the Company, resulting in the commencement of the Recruitment Service provision. By registering for or using the Recruitment Service, the User is deemed to have accepted all terms of the Recruitment Service Terms of Use and the Privacy Policy. Refusal to accept these Terms is only recognized by refraining from registering for or using the Recruitment Service. 

c. Hiring Company

This term collectively refers to companies that have contracted with the Company to introduce candidates meeting their specific requirements based on a separate Recruitment Agreement concluded with the Company, and companies that have concluded a contract with the Company regarding personnel recruitment. 

2. (Application Method) 

Applications for the Recruitment Service must be submitted via the Company’s recruitment agency website or through other methods specified by the Company in advertisements or otherwise. Please note that even after applying and registering, the Company may be unable to provide the Recruitment Service or any of the Company’s other services to individuals who have previously violated the terms of service for any service the Company provides. 

3. (Service Provision)

The Company shall provide the User with appropriate services from among the following, at the Company’s discretion. The User acknowledges that the Company may be unable to provide services depending on the User’s experience, requests, and the status of job openings. 

a. Matching the application details received from the User with the job requirements received from the hiring company, and providing job information based on the matching results

b. Soliciting job applications to the User whom the Company judges to be highly suitable for the job requirements received from the hiring company

c. Supporting the application process

d. Conducting career consultations via telephone or in-person meetings

4. (Duration of Recruitment Service Provision) 

The Recruitment Service shall be provided continuously as long as the Company determines that the User intends to continue job hunting and that job openings suitable for the User are expected to arise. However, regarding service d) specified in the preceding paragraph, it shall generally be provided for a maximum period of three months from the date the Company notifies the individual User of the commencement of said service. Furthermore, if the User joins a hiring company through the Company’s Recruitment Service, provision of the Recruitment Service to the User shall terminate on their start date. If the User requests termination of the Recruitment Service, the Company will promptly terminate them within a reasonable timeframe. 

5. (Changes, Suspension, or Termination of Recruitment Service) 

The Company may, at its discretion and without notice to the Users, modify all or part of the Recruitment Service or temporarily suspend them at any time. Furthermore, the Company may terminate all or part of the Recruitment Service after providing notice for a specified period. 

6. (Grounds for Termination of Recruitment Service Provision) 

The Company may terminate the provision of the Recruitment Service to the User without any prior notice if the User falls under any of the following circumstances: 

a. If the User violates any provision of these Terms;

b. If the User fails to respond to the Company’s communications without justifiable reason;

c. If the User repeatedly makes requests exceeding the scope of the Recruitment Service; and

d. If the Company determines that the trust relationship between the User and the Company cannot be maintained for any other reason

7. (Reapplication for Recruitment Service) 

The Employment Security Act stipulates that the Company shall not encourage job changes for individuals who have secured employment through the Company’s Recruitment Service within the past two years. Should the User wish to utilize the Company’s Recruitment Service again during this period, such use shall be deemed voluntary and based on the User’s own intent, subject to the User’s agreement to these Terms. 

8. (Accuracy of Personal Information)

The User shall provide accurate personal information to the Company and the hiring company, ensuring it is complete and free of discrepancies. Should any objection, claim, or demand arise from the hiring company or other third parties due to inaccurate personal information provided by the User or due to incompleteness or discrepancies in its content, the User shall handle such matters at their own expense and responsibility and shall guarantee that the Company will not be inconvenienced in any way. 

9. (Document Submission)

Upon request by the Company, the User shall promptly submit the following documents: 

a. Identification documents to verify the User’s identity, such as name and address;

b. Residence card or work qualification certificate to confirm residency status; and

c. Other certification documents requested by the hiring company

If the User is currently using or has previously used the Recruitment Service provided by companies other than the Company, the User shall immediately notify the Company. 

10. (Job Matching) 

The Company shall match the application details received from the User with the job requirements desired by the hiring company. However, the Company cannot disclose the evaluation criteria or reasons for its decisions. Furthermore, even if the Company accepts a User’s request to apply for a job, based on the selection criteria provided by the hiring company, the Company may determine the User is not suitable for the position. In such cases, the Company may decide not to recommend the User for that job or may, on behalf of the hiring company, notify the User that they do not meet the job requirements. 

11. (Employment Conditions) 

The Company will facilitate communication with the hiring company regarding employment conditions and other contract details upon the User’s request. However, the User shall, at their own responsibility, directly confirm employment conditions and other contract details with the hiring company before entering into any contract. The User acknowledges that the employment conditions notified by the Company do not ultimately guarantee the details of the contract. 

After receiving a job offer from a hiring company, the User shall not request changes to the employment conditions, including the start date, or other contract details without justifiable reason. However, even if such a request is made with justifiable reason, if the hiring company withdraws the job offer, the Company shall bear no responsibility whatsoever, and the matter shall be resolved between the User and the hiring company. 

12. (Prohibited Acts) 

The User shall not engage in the following acts: 

a. Providing false or inaccurate personal information to the Company or the hiring company;

b. Acts that interfere with the business or operations of the Company or the hiring company, or acts that damage their social credibility or reputation;

c. Acts that slander, defame, or insult other users, employees of the Company or the hiring company, or any other parties involved in the Company’s business (hereinafter referred to as “the Related Parties”); 

d. Infringing upon any property rights, trade secrets, reputation, privacy, etc., including copyrights, trademark rights, and other intellectual property rights held by the Company or the related parties;

e. Using information obtained through the Recruitment Service for purposes other than job hunting, or disclosing or leaking such information to third parties without the Company’s consent;

f. Contacting a hiring company introduced through the Recruitment Service directly without the Company’s consent, and undergoing recruitment screening or joining the company;

g. Bringing a third party to attend an interview or selection test/interview without prior notice and without a valid reason;

h. Failing to attend an interview or selection test/interview or withdrawing after accepting a job offer without prior notice and without a valid reason; 

i. Behavior deemed socially inappropriate in appearance, speech, or conduct during interviews or selection examinations/interviews; and

j. Violating laws, regulations, or public order and morals.

13. (User Consent Items in the Recruitment Selection Process) 

The Company may verify facts with the hiring company if it determines that there is a discrepancy or potential discrepancy between the employment conditions and other contractual information notified by the hiring company and the information reported by the User during the recruitment selection process. The User agrees to this. 

When conducting interviews or selection tests/interviews with the User or hiring companies using an online meeting system, the User agrees to verify their connection environment beforehand and to confirm, at their own responsibility, that there are no impediments to conducting these activities. 

14. (Handling of Copyrights, etc.) 

All copyrights and other proprietary rights pertaining to information created by the Company belong to the Company. 

15. (Exclusion of Anti-Social Forces) 

The User hereby represents and warrants that they are not associated with antisocial forces (This refers to organized crime groups, members of organized crime groups, individuals who ceased being members less than five years prior, quasi-members of organized crime groups, companies associated with organized crime groups, corporate extortionists, individuals posing as social activists or members of specialized violent groups, and other similar entities) and does not engage in illegal activities such as violent acts, fraudulent or coercive acts, or acts of obstruction of business, and shall continue to do so in the future. In the event of a violation of this representation, the User shall accept without objection the termination of the provision of the Recruitment Service. and that it will not engage in any illegal acts such as violent acts, fraudulent or threatening acts, or acts of obstruction of business in the future. 

16. (Disclaimer) 

The User shall use the Recruitment Service acknowledging that employment is not guaranteed through their use, and that any disputes arising with the hiring company regarding working conditions or other contractual terms shall be resolved through negotiation with the hiring company at the User’s own responsibility and expense. Furthermore, if the User suffers damage as a result of using the Recruitment Service, and if the Company is found to be at fault, the Company shall only be liable for damages that are directly and ordinarily caused thereby, and shall not be liable for any other damages. However, this shall not apply if the damage was caused by the Company’s intentional act or gross negligence. 

17. (Force Majeure) 

The Company shall not be liable for any damages incurred by the User if the provision of the Recruitment Service is delayed, becomes difficult, or becomes impossible due to natural disasters, network failures, virus damage that cannot be prevented by standard virus countermeasures, or other reasons beyond the Company’s control. 

18. (Liability for Damages) 

If the User violates any provision of these Terms and causes damage to the Company, its affiliates, or third parties, the User shall compensate for such damage. 

19. (Amendment of These Terms) 

The Company reserves the right to modify the terms of these Terms as necessary. The revised Terms shall be posted on a specific webpage linked from the top page of the Company’s recruitment website. The Users who continue to use the Recruitment Service one month after posting shall be deemed to have agreed to the revised Terms. 

20. (Language) 

The language of these Terms shall be Japanese. Even if these Terms are translated into other languages, such translations are provided for reference only. The Japanese version is the only version that constitutes the binding terms and conditions. In the event of any discrepancy between the Japanese version and any translation, the Japanese version shall always prevail over the translation in any other language. 

21. (Matters Not Covered) 

Matters not stipulated in these Terms shall be resolved through sincere consultation between the User and the Company in accordance with the provisions of Japanese laws and regulations. 

22. (Jurisdiction) 

In the event of any dispute arising in connection with any provision of these Terms, the Tokyo District Court or the Tokyo Summary Court shall be the exclusive agreed court of first instance. The arbitration venue shall be Tokyo, and the language of arbitration shall be Japanese.
